These Terms of Service (“Terms”) govern your access to and use of dekohaus.ae (the “Website”) and the purchase of products and services offered by Deko Haus Building Materials Trading L.L.C (“Dekohaus,” “we,” “us,” or “our”). By using the Website or placing an order, you agree to these Terms.

2. Acceptance of Terms

By accessing the Website, requesting a quotation, or placing an order, you confirm that you are at least 18 years old and have the authority to enter into a binding agreement. If you do not agree to these Terms, do not use the Website.

3. Scope of Products & Services

• Residential focus: Dekohaus serves residential customers with bespoke kitchens, vanities, cabinets, wall décor, and lighting solutions.
• Custom & made-to-order: Many items are customized to your specifications (dimensions, materials, finishes), which impacts timelines and eligibility for returns.
• Visualizations: Any 3D renders, AI-assisted plans, drawings, and samples are illustrative. Actual colors and textures may vary due to device displays, lighting, and natural material variance.

4. Quotations, Pricing & Taxes

• Quotations: Prices, inclusions, exclusions, and validity periods are stated on your written quotation. Prices may change before order confirmation due to material availability or exchange-rate movements.
• Currency & VAT: Prices are quoted in AED and, unless stated otherwise, are exclusive of 5% VAT. VAT and any applicable duties/fees are added to the final invoice.
• Scope changes: Any post-approval changes (materials, dimensions, accessories) will be quoted separately and may affect timelines.

5. Orders, Deposits & Payments

• Order confirmation: An order is confirmed only upon written approval of drawings/specifications and receipt of the advance payment stated in your quotation.
• Milestones: Payment milestones (e.g., deposit, production, delivery/installation) are set out in your quotation and invoices.
• Overdues: Late payments may pause manufacturing/scheduling and can incur storage or rescheduling fees.
• Non-refundable components: For customized items, deposits and amounts covering ordered materials, production, or third-party services are non-refundable once those stages have begun.

6. Design, Approvals & Site Readiness

• Measurements: We can measure on site, but you must verify final dimensions and site constraints (walls, plumbing, electrical, HVAC). Hidden conditions may require adjustments and variation charges.
• MEP coordination: Electrical, plumbing, gas and ventilation must meet our drawings/specifications. Any rework from non-conformity is chargeable.
• Access & permits: You are responsible for building permits, access permissions, elevator bookings, and working-hour restrictions, unless otherwise agreed in writing.

7. Manufacturing, Delivery & Installation

• Lead times: Typical production and delivery timelines range from 4–12 weeks from order confirmation and cleared deposit, subject to approvals, site readiness, customs, and supplier schedules.
• Scheduling: We will coordinate a delivery/installation window; last-minute changes or failed site readiness may incur re-visit fees.
• Risk of loss: Risk passes on delivery to site; title passes upon full payment.

8. Warranty & After-Sales Support

• Cabinetry warranty: Dekohaus provides a 10-year warranty on cabinetry against manufacturing defects under normal residential use. Hardware/accessories follow the original manufacturer’s warranty terms.
• Exclusions: Normal wear and tear, improper use, water/heat damage, chemical cleaners, unauthorized modifications, and issues arising from site conditions or third-party work are excluded.
• Claims: Report issues with photos, order number, and a description. We may repair or replace defective parts at our discretion.

9. Returns, Exchanges & Cancellations

• Custom products: Made-to-order and customized items are not returnable after production has started.
• Standard items: If applicable, unopened, resaleable standard items may be returnable within the period stated on your invoice/quotation; inspection and restocking fees may apply.
• Cancellations: Pre-production cancellations may be accepted subject to deduction of any costs incurred (design, administration, special-order materials).
• Refunds: Approved refunds are processed to the original payment method in AED. Bank/processing fees and VAT handling follow applicable UAE law.

10. Website Use & Intellectual Property

• License to use: We grant a limited, non-exclusive, non-transferable license to access the Website for personal, non-commercial use.
• Prohibited conduct: Do not reverse-engineer, scrape, interfere with security, transmit malware, or use the Website to infringe rights or applicable laws.
• IP ownership: All content, designs, images, renderings, trademarks, and logos are owned by or licensed to Dekohaus. No rights are granted except as expressly stated.
• User content: If you submit content (measurements, photos), you grant Dekohaus a non-exclusive license to use it to provide services. You represent you have rights to that content.
• Third-party links/tools: We are not responsible for third-party sites or services linked from the Website.

11. Disclaimers & Limitation of Liability

• The Website and visualizations are provided “as is.” We disclaim implied warranties to the maximum extent permitted by law.
• To the fullest extent permitted, Dekohaus is not liable for indirect, incidental, or consequential damages. In all cases, our total liability for a claim related to a specific order is limited to the amount paid for that order.

12. Force Majeure

We are not liable for delays or failure to perform due to events beyond our reasonable control (e.g., extreme weather, supply-chain disruptions, customs delays, strikes, acts of government).

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the United Arab Emirates and the Emirate of Dubai. Courts of Dubai shall have exclusive jurisdiction over any dispute arising from these Terms.

14. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on this page with the updated “Effective Date.” Your continued use of the Website or proceeding with an order after changes are posted constitutes acceptance.
